The Independent National Electoral Commission (INEC) alleged on Tuesday that Barr. Hudu Yunusa Ari, the suspended Resident Electoral Commissioner (REC) in Adamawa State, and his surety were evading arrest, resulting in their ongoing absence.
INEC’s counsel, Rotimi Jacobs, SAN, conveyed this information to the Adamawa High Court, presided over by Justice Benjamin Manji Lawan, stating that Hudu Ari had not been arraigned due to the authorities’ inability to apprehend him.
Hudu had been brought to court by INEC, facing a 6-count charge related to announcing false electoral results, violating the oath of neutrality, breaching duties, engaging in disorderly conduct during elections, inciting disturbances, and impersonating a public servant.
During the recent court hearing, Rotimi Jacobs, SAN, representing the prosecution, informed the court that the defendant had declined an invitation from the Investigative Police officer (IPO) after receiving a hearing notice.
He requested an adjournment to allow the police to effect his arrest for subsequent arraignment and trial, or alternatively, to request a court-issued arrest warrant.
The IPO, known in court as CSP Moses Jolujdo, confirmed that both the defendant and his surety had been avoiding arrest.
Presiding Judge Benjamin Manji Lawan approved the application and scheduled the case’s next hearing for November 22, 2023.
Addressing the media, INEC’s counsel, Rotimi Jacobs, emphasized, “The defendant has been evading arrest. He is in hiding, and his lawyers are encouraging him to do so.”
He urged the police to intensify their efforts to apprehend him and ensure his prosecution.
