The Court of Appeal sitting in Lagos has sacked Hon. Destiny Nwagwu as the member representing Aba North state Constituency at the Abia State House of Assembly, marking another blow for the ruling party in the state
The three-member panel unanimously ruled that Hon. Nwagwu could not substantiate his membership with the Labour Party (LP) before the election, as required by section 77 of the Electoral Act.
Consequently, the court declared the respondent’s nomination invalid, rendering him ineligible for the March 18 State House of Assembly election.
As a result, Hon. Aaron Uzodike from the Peoples Democratic Party (PDP) was affirmed as the rightful winner and duly elected representative for Aba North State Constituency at the State House of Assembly.
This development further highlights the trend of LP-affiliated lawmakers losing their positions due to court decisions in Abia state.
It also solidifies the PDP’s position, amplifying their presence as the dominant force in the State Assembly with an absolute majority.”
